Terms of Use

These Terms of Use ("Terms") apply to everyone who visits or uses Collab (the "Site"), operated by Collab ("we", "us"). By creating an account or using the Site you agree to these Terms, together with the Artist Terms or Developer Terms that apply to you and our Privacy Notice. If you do not agree, please do not use the Site.
1. What the Site is
Collab is a community directory and messaging platform. It lets game developers, studios, artists, illustrators, designers and other creatives ("Members") showcase their work, advertise services, post projects and talk to each other.
We are an introduction platform only. We do not provide creative services, we do not employ or engage any Member, and we are not a party to any agreement made between Members.
2. Independent Members — no agency or employment
- Every artist and other service provider on the Site acts as an independent agent / independent contractor operating their own business.
- No Member is an employee, worker, partner, agent or representative of Collab. No Member has authority to make promises, contracts or statements on our behalf.
- Any agreement for work ("Commission" or "Job") is made directly and solely between the Members involved.
3. No payments through the Site
- The Site does not take, hold, process or guarantee any payment.
- Artists and service providers are responsible for providing their own payment method (for example their own invoicing or payment provider) and for their own taxes, invoices and records.
- Developers and clients pay providers directly, outside the Site, and at their own risk. We strongly recommend agreeing scope, price, deadlines, revisions, usage rights and payment terms in writing before any work starts.
- We will never ask you for payment details through the inbox. Report anyone who asks you to pay in suspicious ways.
4. Disputes between Members
Any dispute about a Commission — including quality, deadlines, refunds, non-payment, non-delivery or copyright — must be taken up directly between the Members involved. We are not responsible for resolving disputes, issuing refunds or enforcing agreements. We may, at our discretion, review complaints about conduct on the Site (see section 8), but that does not make us a party to the dispute.
5. Accounts
- You must be at least 18 years old (or the age of majority where you live) to create an account.
- Information on your profile must be accurate and you must not impersonate anyone.
- You are responsible for keeping your password secure and for everything done through your account.
- One person or business per account. Do not create accounts to get around a suspension.
6. Accountability: reviews and ratings
- Reviews can only be left by Members who were party to a completed Job. Every review is publicly signed with the reviewer's name and profile. Anonymous reviews are not allowed.
- Reviews must be honest, based on your own genuine experience, and must not contain abuse, personal data or false statements.
- Do not offer or accept anything in return for a review, and do not threaten bad reviews to gain leverage.
- We may remove reviews that break these Terms, but we do not otherwise edit or verify reviews.
7. Your content and intellectual property
- You keep ownership of everything you upload. You confirm you own it or have permission to use it.
- You give us a non-exclusive, worldwide, royalty-free licence to host, resize, convert (for example to WebP), watermark and display your content on the Site for as long as it is on the Site.
- Watermarking and right-click blocking are deterrents only; we cannot prevent others from copying images viewable in a web browser.
- Ownership of, and licences to use, commissioned work are a matter for the agreement between the Members involved.
- If you believe content on the Site infringes your rights, report it via the Report a problem page.
8. Prohibited conduct
You must not:
- commit or attempt fraud, scams, chargeback abuse or non-payment, or take payment without delivering;
- harass, threaten, discriminate against or abuse anyone;
- upload stolen, plagiarised, illegal or sexually explicit content, or content created to deceive;
- post spam, unsolicited advertising or misleading listings;
- leave fake, retaliatory or paid-for reviews;
- collect other Members' data or use it for anything other than discussing work on the Site;
- interfere with the Site's security or operation, or use bots or scrapers.
9. Reports, moderation and suspension
- Any Member can report another Member, a message, a review, an offer or a project. Reports are not anonymous to us, but we do not show the reporter's identity to the reported Member.
- We may investigate reports, remove content, issue warnings, and suspend or permanently close accounts at our discretion, with or without notice, especially in cases of suspected fraud or repeated complaints.
- Suspended Members cannot sign in and their profiles and listings are hidden.
- Knowingly false reports are themselves a breach of these Terms.
10. Disclaimers and limitation of liability
- The Site is provided "as is" and "as available". We do not guarantee that the Site will be uninterrupted or error-free, or that any Member is who they say they are, is qualified, or will perform.
- To the fullest extent permitted by law we are not liable for: the acts, omissions, work, payments or conduct of any Member; any agreement between Members; or any indirect or consequential loss, loss of profit, revenue, data or goodwill.
- Our total liability to you for anything arising from the Site is limited to £100.
- Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or fraud.
11. Indemnity
You agree to compensate us for any claims, losses or costs (including reasonable legal fees) arising from your content, your agreements with other Members, or your breach of these Terms.
12. Changes
We may update these Terms. When changes are significant we will ask you to accept the new version next time you sign in. If you do not accept, you must stop using the Site.
13. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory consumer law in your country says otherwise.
